People affected by anticompetitive practices in Romania can ask damages in court
The people or companies that have suffered a damage because a company has breached the competition laws will be able to claim damages in court, according to an emergency ordinance the Government approved on Wednesday.
The bill introduces new rules in the competition area.
The Bucharest Courthouse will be able to solve the damage claims. Its decisions can be challenged at the Bucharest Appeal Court and the High Court of Cassation and Justice.
Those who have suffered a damage are entitled to full compensation, according to the bill. The right to damages is prescribed within 5 years. The prescription period doesn’t begin to run before the anti-competitive practice ends and before the applicant has known the behavior.
