Romanian Govt. announces new rules for public acquisitions

Romania’s Government is working on new rules for public acquisitions aimed at speeding up the contracting process.

A new provision may be introduced in the public acquisitions law, which would allow the contracting authority to sign the contract even when the result of a public tender is challenged by the losing bidders, local Hotnews.ro reported.

Thus, if the National Council for Solving Complaints rejects the complaint, the contracting authority can move on and sign the contract with the winner of the tender, even if the challengers go to court, according to finance minister Eugen Teodorovici. If a court later rules in favor of the challenger, the contracting authority will pay part of the profit margin the bidder would have made from the respective contract.
