Government Emergency Ordinance no. 4/2013 amending Law no. 76/2012 for the implementation of Law no.134/2010 on the Civil Procedure Code and amending and completing certain related enactments, as approved by Law no. 214/2013

Starting with 1 August 2013, the informational meetings on the benefits of mediation are mandatory for certain civil and criminal disputes.

Civil disputes for which the informational meeting on the benefits of mediation is mandatory 

- Civil disputes having as object an amount lower than RON 50.000, with some exceptions such as the payment summons procedure or the procedure regarding the claims with low value (not exceeding RON 10,000);

- Employment disputes arising out of the conclusion, performance and termination of individual employment contracts;

- Disputes regarding consumer protection, when the consumer claims to have suffered a prejudice as result of: defective products or services, the other party’s failure to observe contractual clauses or granted warranties, the existence of abusive clauses contained in the contracts concluded between consumers and economic operators, or the violation of the other rights provided by the national or European Union legislation concerning consumer protection;

- Disputes on professional liability;

- Disputes on family law;

- Disputes on possession, bordering, bordering changes, as well as any other disputes on neighbor relationships.

The information procedure on the benefits of the mediation procedure may be carried out by a judge, prosecutor, legal counsel, attorney-at-law, public notary.

The term for completing the information procedure

The duration of the information procedure, including the formalities for summoning the parties, shall not exceed 15 calendar days.

Sanctions

In case the plaintiff does not observe the obligation to attend the information meeting on mediation prior to filing a legal action before the court, the court shall dismiss the plaintiff’s action as inadmissible. The court may grant a term for completing the information procedure.
