Disciplinary action against Romanian prosecutors who investigated OUG13

The Judicial Inspection, the Romanian institution that investigates the disciplinary misconduct of magistrates and sends sanction proposals to the Superior Council of Magistracy (CSM), has started a disciplinary investigation into the activity of three prosecutors. The three, Marius Bulancea, Paul Dumitriu and Jean Uncheselu, had launched an inquiry into how the controversial bill OUG 13 had been adopted, according to judicial sources, reports Economica.net. They looked into the approval of the emergency ordinance that aimed to change the Criminal Code (OUG 13), but was finally repealed after massive street protests. The judicial inspectors will now check whether the three anti-corruption prosecutors have exercised their office in bad faith or with serious negligence. The Judicial Inspection will send its report to CSM. DNA decided to open the investigation related to the OUG 13 in early-February. However, at the end of the same month, referring to this investigation, the Constitutional Court said that there was a legal conflict between the Government and the DNA. Thus, the anticorruption prosecutors closed part of the case and sent the rest to the General Prosecutor’s Office, which then closed the investigation on the emergency ordinance, and sent a part of the case back to the DNA. editor@romania-insider.com
