Bill: Employers in Romania who don’t transfer social contributions risk jail

Employers that fail to pay social contributions on behalf of their employees may go to jail, according to an emergency draft law launched into public debate on Friday last week, cited by local Mediafax.

The bill provides that failing to retain and pay a list of 32 contributions, taxes and fees will be sanctioned with prison sentences ranging between one year and six years. The list of 32 contributions, taxes and fees includes social contributions, the tax on dividend, the income tax, the tax on interest income, the tax on income from pensions.

Social contributions will be transferred to employees from next year. However, employers will have the obligation to collect them from the employees and pay them to the state. If the employers fail to do that within 30 days after the deadline provided by the law, they risk going to jail, according to the new bill.
