Romania's Govt. prepares to adopt the Administration Code

The Administration Code, a set of regulations for the local administration, may be adopted by the Government as a law draft in the next period, according to political sources quoted by local Hotnews.ro.

The code, which was included in the Social Democratic Party’s governing program, was announced this summer by former development minister Sevil Shhaideh.

One of the most controversial provisions included in the Administration Code is that prosecutors will no longer be allowed to assess the necessity and opportunity of administrative decisions. As a result, the prosecutors will no longer be able to investigate ministers for the decisions they make.

Romania’s Constitutional Court recently ruled that ministers can’t be investigated for passing emergency ordinances. However, the Administration Code may provide that government decisions can’t be investigated.
