Romanian court postpones decision on same-sex marriages concluded abroad

Romania’s Constitutional Court has postponed again the decision on whether same-sex marriages concluded abroad should be recognized in Romania or not. The matter will be discussed at the end of October.

The case is complex and has a high media impact, Valer Dorneanu, president of the Constitutional Court, explained. He argued that the court needs to study the EU law, several treaties, as well as all the interventions made by NGOs and associations, reports local News.ro.

A gay couple, made of a Romanian man and his US-born partner, have challenged a provision of the Romanian Civil Code which prevents the recognition of the same-sex marriages concluded abroad.

Romanian Relu Adrian Coman and US citizen Robert Clabourn Hamilton got married in Brussels in 2010. The two men started the legal proceedings, after Adrian Coman tried to get the right for his husband Robert Clabourn Hamilton to live in Romania. “Clai” Hamilton can’t stay in Romania for periods longer than three months as a family member, although he is married to a Romanian citizen.
