No more “positive discrimination” for SMEs in public tenders in Romania

The Ciolos Government has removed the facility for small and medium-sized companies participating in public tenders.

The Government adopted on Monday an emergency ordinance that repeals a law from 2004, which grants these firms some privileges. The SMEs have benefitted from special conditions in public tenders, such as a 50% reduction in the criteria for turnover, participation guarantee, and performance guarantee.

They will now have to take part in public tenders in the same conditions as other companies. The European Commission said that this facility meant “positive discrimination”.
